Trademark Infringement Case

Trademark Infringement Case

1999: Fully collectible judgment against major celebrities for over $110,000. The Firm carried this trademark infringment case to a startling conclusion on the west coast. Two celebrities sued the Firm’s client, a retailer of autographed collectibles, for unlawfully appropriating their images. Although the case was originally filed in California Superior Court, the firm succeeded in vacating a default judgment, removing to U.S. District Court, and prevailing on summary judgment (eventually affirmed by the 9th Circuit Court of Appeals). As the lawsuit was based on a provision of the California Civil Code that compelled an award of attorneys’ fees to the prevailing party, the firm obtained for the client a judgment against these internationally famous celebrities for over $110,000.
