Chapter 11: What Is A Plan Of Reorganization?

Thoughts from a Maryland Bankruptcy Attorney

In a Chapter 11 case the document that dictates the rights and oblgiations of the parties is the Plan of Reorganization. In this document, a debtor (or, occasionally, a creditor) proposes treatment of different classes of creditors. Once confirmed, the Plan is binding on all creditors, even if they vote to reject the Plan or don’t vote at all.

In this video Baltimore Bankruptcy Lawyer Ron Drescher discusses the role of a Plan of Reorganization in the Chapter 11 process.
