Payroll deduction into a 401(k) plan is a tremendous benefit offered by many employers. However, in Chapter 13 when a debtor is supposed to pay over all their net disposable income, making these payment deductions will be at the expense of creditors. The influential 6th Circuit Court of Appeals has spoken about what happens after a debtor finishes repaying a 401(k) loan during a Chapter 13 repayment plan.
