Bankruptcy: What is Discharge?

I think of discharge as the pot of gold at the end of the bankruptcy rainbow. What does that mean? It means if you’ve spent years of your life accumulating debt, and you decide you’re ready to file bankruptcy, you’ll want to discharge that debt. You want to shed that debt so that you can emerge free from the phone calls, the complaints, the lawsuits, the wage garnishments, the bank account garnishments; anything else that your creditors can do to seize your money to repay the debts.

A lot of people confuse discharge with rights against property or closing or dismissal of a bankruptcy case. Discharge happens when an honest debtor exposes information about all of their information, all of their assets and their debts and their income and their expenses to the bankruptcy court and the bankruptcy trustee. There’s no substitute for complete honest, transparent disclosure of the information.
